These Terms of Service (“Terms,” “Agreement”) constitute a legally binding agreement between Sorrow (“Sorrow,” “we,” “us,” “our”), the entity operating the software application known as “Sorrow Bot” (the “Bot”), accessible through the Discord platform and via the domain sorrow.rest (the “Website”), and the individual or entity accessing or utilizing the Bot, Website, or any associated services (collectively, the “Services”), hereinafter referred to as “you,” “your,” or “User.” References to “Sorrow Bot,” “the Bot,” or “the Service” shall encompass all features, functionalities, premium offerings, application programming interfaces, commands, and ancillary tools provided under the Sorrow brand. This Agreement is supplementary to and should be read in conjunction with our Privacy Policy and Refund Policy. By adding Sorrow Bot to a Discord server, authorizing it as a User App, or otherwise accessing any component of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to any provision of these Terms, you must immediately discontinue all use of the Services.
You must be at least thirteen (13) years of age, or the minimum age required by the laws of the jurisdiction in which you reside, whichever is greater, to access or use any component of the Services. By using the Services, you represent and warrant that you meet the applicable age requirement and possess the legal capacity to enter into this binding Agreement. Sorrow reserves the right to immediately and permanently terminate access for any User found to be below the minimum age threshold, without notice, refund, or compensation of any kind. By accessing the Services, you agree to comply with the following conditions. Violation of any of these provisions may result in immediate termination of your access, at Sorrow's sole discretion, without prior notice or right to a refund as outlined in our Refund Policy:
Sorrow offers Premium subscription tiers that grant access to enhanced features, increased usage limits, and exclusive commands. All Premium purchases are processed exclusively through OxaPay, a third-party cryptocurrency payment processor. By initiating a purchase via the /premium purchase command, you acknowledge and agree that: (a) all transactions are conducted on the blockchain and are inherently final and irreversible; (b) you are solely responsible for any network fees imposed by the respective cryptocurrency network; (c) Sorrow bears no liability for failed, delayed, or incorrect transactions resulting from user error, wallet misconfiguration, or network congestion. All purchases are subject to our Refund Policy, which governs the finality of all transactions. For details on how payment data is handled, see our Privacy Policy.
All content, features, functionality, code, design elements, trademarks, logos, and other intellectual property associated with the Services are and shall remain the exclusive property of Sorrow. No right, title, or interest in or to any component of the Services is transferred to you by virtue of these Terms or your use of the Services. Unauthorized reproduction, distribution, modification, or creation of derivative works based on any part of the Services is strictly prohibited and may result in termination of access and legal action.
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Sorrow does not warrant that the Services will be uninterrupted, error-free, secure, or available at any particular time or location. Temporary interruptions due to maintenance, updates, infrastructure changes, or unforeseen circumstances do not constitute a breach of these Terms and shall not give rise to any claim for refund, credit, or compensation. Sorrow reserves the right to modify, suspend, or discontinue any feature or component of the Services at its sole discretion, with or without notice.
To the maximum extent permitted by applicable law, Sorrow, its operators, affiliates, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, or damages arising from your use of or inability to use the Services, regardless of the theory of liability and even if Sorrow has been advised of the possibility of such damages. In no event shall the total aggregate liability of Sorrow exceed the amount paid by you, if any, for access to the Services during the twelve (12) months preceding the event giving rise to the claim.
Sorrow reserves the absolute right to restrict, suspend, or permanently terminate your access to any or all components of the Services at any time, for any reason or no reason, with or without cause, and with or without prior notice. Grounds for termination include, but are not limited to, violation of these Terms, abuse of the Services, fraudulent activity, or conduct deemed harmful to other Users, the Services, or third parties. In the event of termination, no refund shall be issued for any remaining Premium subscription time, as set forth in our Refund Policy. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property, limitation of liability, indemnification, and governing law provisions.
You agree to indemnify, defend, and hold harmless Sorrow, its operators, affiliates, and contributors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any third-party rights.
Sorrow reserves the sole and absolute right to amend, modify, supplement, or replace these Terms in whole or in part at any time and without prior notice. Any such modifications shall become effective immediately upon publication on sorrow.rest. It is your sole responsibility to review these Terms periodically for changes. Your continued access to or use of any component of the Services following the posting of any modifications constitutes your binding acceptance of the revised Terms. If you do not agree with any modification, your sole remedy is to discontinue use of the Services.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any remaining provisions, which shall continue in full force and effect.
These Terms shall be governed by, construed, and enforced in accordance with the laws of România, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, shall be subject to the exclusive jurisdiction of the competent courts located in București, România. You hereby irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue therein.
The Services are developed, maintained, and operated by Sorrow, registered in București, România. All services, features, and offerings are provided exclusively under the Sorrow brand.
